6885 Coyote Road, Las Cruces · asking $115,000. Answer a few questions, read your contract, sign with your finger, and your offer goes to Manny Patino at Patino Real Estate.
New Mexico law protects the agreement you may already have with an agent, so we ask before anything else.
A real estate agent is a licensed person who helps you find a home and writes your offer. If an agent has been helping you, tell us, because they may already represent you. If not, Patino Real Estate writes this offer for you, and you pay us nothing: our fee is asked from the seller.
A buyer brokerage agreement is a contract that makes one agent your agent for a set time. If you signed one, that agent is the one who writes your offer. If you are not sure, choose Not sure and Manny will help you check.
When you have signed with an agent (or are not sure), that agent is the one to write your offer, and we respect that. Call your agent and send them this home. If your agreement has ended or you have questions, leave your name and Manny will call you.
If an agent opened the door and walked you through this home, tell us who. That way everyone involved is treated fairly. Saying yes does not stop your offer.
Before you see anything to sign, New Mexico requires us to tell you what every broker owes you (Real Estate Commission rule 16.61.19.8 NMAC) and to get your acknowledgement. Manny Patino, Qualifying Broker of Patino Real Estate, works with you as a transaction broker.
Every broker owes every buyer and seller:
Because we work with you directly, we also owe you:

You may also work with another brokerage, or with none. The full rule is published by the New Mexico Real Estate Commission at rld.nm.gov.
Names go on the contract exactly as typed, with middle names.
Answer Yes only if you, or the other buyer, holds a New Mexico real estate license. The law requires it to be written in the contract. Most buyers answer No.
If you have walked through the home in person, choose Yes. If you have only seen photos or a video, choose Not yet. Either way you can still have the home inspected before you are committed.
By continuing you agree that Patino Real Estate may call, text and email you about this offer. Message and data rates may apply. Reply STOP to end texts.
Very few home sellers accept seller financing, so Manny asks the seller first. Call 575 520 7604 or send a text.
Cash means you pay the whole price with your own money. Conventional is a regular bank loan. FHA is a government backed loan with a low down payment, popular with first time buyers. VA is for veterans and service members. USDA is for homes in rural areas. Your pre-approval letter from your lender says which one you have.
A pre-approval letter is a letter from a lender that says how much they will lend you. Proof of funds is a bank statement that shows you have the cash. Sellers take an offer more seriously with one. You can make your offer without it, but you have to give it to the seller within 3 days after they say yes.
Earnest money is a deposit that shows the seller you are serious. You do not pay it today. If the seller says yes, you take it to the title company within 3 days, and they hold it. It is not an extra cost: it counts toward your price at closing. If you cancel for a reason the contract allows, like the inspection, you get it back. We filled in the amount we recommend for this price, and you can change it.
Independent consideration is a small payment that makes your right to inspect the home and cancel legally binding in New Mexico. It must be more than zero, and $50 is what we recommend. You take it to the title company with the earnest money. The seller keeps it even if you cancel, but if you buy the home it counts toward your price at closing.
Settlement, also called closing, is the day you sign the final papers at the title company. Funding is when the money moves and you get the keys, usually the same day. A loan usually needs about 30 to 45 days. Cash can close sooner.
Your offer stays open until 5:00 PM on this day. If the seller has not signed by then, your offer ends and you are free. Two or three days is normal.
Choose Yes if you will live in this home. Lenders ask, and living in it usually gets you a better loan. Choose No if you will rent it out or it is an investment.
Closing costs are the lender and title company fees you pay at closing, on top of your down payment. You can ask the seller to pay part of them. It makes your offer less attractive to the seller, and your loan limits how much is allowed.
If you need to sell the home you own now to buy this one, your offer can depend on that sale. That is called a sale contingency. Sellers like it less because it adds a step that can fall through.
Appliances and other things that are not attached to the house only stay if the contract says so. Check everything you want to stay. Anything not checked, the seller can take.
You hire and pay a home inspector to check the house. If they find problems, you can ask the seller to fix them or lower the price, or you can cancel and get your earnest money back. Waiving means you buy the home as it is: your offer looks stronger, but you lose that protection.
An appraisal is an independent opinion of what the home is worth. A loan always requires one. With cash it is your choice. If you ask for one and it comes in below your price, you can renegotiate or cancel.
A home warranty is a one year service plan that pays for repairs on things like the heating, cooling and water heater. You can skip it, pay for it yourself, or ask the seller to pay for it.
The title company holds the deposits, makes sure the seller really owns the home, and runs the closing. If you do not have one in mind, leave this empty.
