Broker Duties disclosure, New Mexico Real Estate Commission rule 16.61.19.8 NMAC
Patino Real Estate, Manny Patino, Qualifying Broker, is the listing brokerage for the seller in this transaction and is not directly providing real estate services to the buyer. New Mexico requires every broker to give you this disclosure before presenting any document that could become a written agreement, and to obtain your written acknowledgment that you received it.
Read the Broker Duties owed to you
Brokers owe the following duties to prospective buyers, sellers, landlords and tenants:
Honesty and reasonable care and ethical and professional conduct.
Compliance with local, state and federal fair housing and anti-discrimination laws, the New Mexico real estate license law and the real estate commission rules, the New Mexico Uniform Owner Resident Relations Act, and other applicable local, state and federal laws and regulations.
Performance of any and all written agreements made with the prospective buyer, seller, landlord or tenant.
Written disclosure of any potential conflict of interest that the broker has in the transaction, including any written brokerage relationship the broker has with any other party to the transaction, any material interest or relationship of a business, personal or family nature that the broker has in the transaction, or any written agreement the broker has with a transaction coordinator who will be providing brokerage services related to the transaction.
Written disclosure of any adverse material facts actually known by the associate broker or qualifying broker about the property or the transaction, or about the financial ability of the parties to the transaction to complete the transaction; adverse material facts requiring disclosure do not include any information covered by federal fair housing laws or the New Mexico Human Rights Act.
In addition, brokers owe the following duties to the party to whom the broker is directly providing real estate services: assistance in completing the transaction, including timely presentation of and response to all written offers or counter offers and active participation in complying with the contract; acknowledgment that there may be matters outside the broker's knowledge or expertise, with a suggestion to seek expert advice; advice to consult with an attorney regarding the effectiveness, validity or consequences of any written document generated by the brokerage or presented to the party that has the potential to become an express written agreement; prompt accounting for all money or property received; maintenance of confidential information learned in any prior agency relationship; written disclosure of the brokerage relationship options available in New Mexico; and, unless otherwise authorized in writing, no disclosure of a seller's willingness to accept less than the listed price, a buyer's willingness to pay more than the offered price, either party's motivation, or other confidential information.
Brokerage relationship options in New Mexico: you may hire your own broker under a written agreement, or you may proceed without representation. The listing broker's duties to you are the ones in the first list above. You are advised to consult an attorney about the purchase agreement before you sign it. Your Buyer Brokerage Agreement (NMAR Form 1206)
You are buying without your own agent. New Mexico requires a written agreement before a brokerage assists a buyer with a purchase, so one is signed together with this offer. What it says:
Patino Real Estate, Manny Patino, Qualifying Broker, works with you as a transaction broker. On this property it is also the seller's broker, so it acts for both sides without representing either one as an agent. You consent to that on Cover Page 2 of the purchase agreement.
Scope and term: it covers your purchase of a home in Las Cruces and Doña Ana County for one year from today, this home or another one we help you buy if this one does not work out.
Compensation: paid by the seller under the listing agreement, and nothing is due from you. If on some purchase the seller pays no compensation, the commission terms get renegotiated in writing before going further.
It is an exclusive agreement for that year. Ask us anything before you sign.
